Four Seasons Swim Club pool rules

WEATHER RELATED CLOSINGS


The pool will occasionally need to close due to inclement weather.


Weather conditions that will cause the pool to close include, but are not limited to, outside temperature of less than 70 degrees, lightning, thunder, and rain.


Swimmers are not allowed in the water during and up to one-half hour after thunder or lightning storms. Members are not to engage pool staff in disputes over whether thunder or lightning was heard/seen once the staff have made the call.  


If the weather has thunder or lightning activity, members will be encouraged to go home for safety.  Those staying at the pool will be kept in the club house for their safety.  When the Pool Manager decides to close the pool, repeated announcements will be made as to the time the pool will close and a sign indicating the pool is closed will be placed at the entrance.


If the pool is not open at noon due to weather, the Pool Manager will check the weather again no later than 3:00 PM. If the pool is not opened at 3:00 PM, the Pool Manager will make another decision about opening the pool by no later than 6:00 PM. If the pool is not opened at 6:00 PM, it will be closed until the following day. If the pool is closed any time after 6:00 PM, it will remain closed until the following day.

I. Discipline

A. The Club Manager, under the supervision of the Board, or their designated representative is the final authority on matters of discipline. His or her instructions must be followed or disciplinary actions in the form of suspensions of Club privileges will result.


II. Hours

A. The pool will be open Monday through Friday from 9:00 AM to Noon for Swim Team practice and Swim Lessons.

B. General swimming will occur daily from Noon to 9:00 PM. Hours will be reduced when school is in session. Check signage at the Pool check-in desk, the newsletter, and/or website for updates.

C. The pool may close for maintenance operations, health conditions, weather, or any reason deemed sufficient by the Club Manager or his/her designated representative - notification will be sent via the Remind app (members are responsible for signing up for the app on their own using the link on the Four Seasons website or the QR code posted at the pool).

D. The pool will open Memorial Day weekend, weather permitting, and shall close on Labor Day.

E. Sufficient notification, preferably at least one week, will be given if any special event is scheduled which will change any of the times specified. This includes swim meets. Notification will be in the newsletter. 

F. All members and their guests must sign in and out, members must be present with guests at all times.


III. Rules of Conduct

A. Vehicles shall be driven slowly (10 MPH) and carefully in driveways and parking areas. Bicycles shall be ridden on driveways and parking areas and shall be parked only in designated areas where bicycle racks are located. Bicycles, or other wheeled recreational devices are not permitted inside the pool fencing or on the tennis courts, without board approval. 

B. Members are responsible for cleaning up after themselves. Trash must be placed in the appropriate containers. 

C. Members, age 21 and older, may be allowed to bring and consume alcohol on the premises at the discretion of the Four Seasons Board. Canned beverages should be placed in a can cooler or koozie. Beverages may also be poured into plastic or metal cups. NO GLASS containers are allowed. Members who consume alcohol on the premises are expected to consume responsibly and are responsible for their behavior while drinking. The Four Seasons Board and Pool Management reserve the right to eject any intoxicated members and/or their guests for inappropriate or disruptive behavior on pool premises.

D. There will be no socializing with on-duty lifeguards or snack bar workers.

E. No fireworks of any type, including sparklers, torpedoes, cap guns, etc., are permitted on club premises, except with Board approval.

F. No profane or abusive language will be permitted on Club premises.

G. The cost of any intentional or malicious property damage will be charged to the responsible Club member. 

H. All members and guests shall give full consideration and regard to the rights and privileges of others.

I. The use of chaise lounge chairs is restricted to adults 18 and over when the pool is busy. An announcement will be made for children under 18 to move their belongings to other chairs if enough chaise lounge chairs are not available for adults.

J. Responsible Use of Technology: All members are required to respect the family nature of the pool. WiFi is available to members age 18 and over.

K. The pool is not responsible for any personal belongings. Members and guests are encouraged to leave any valuables locked in their cars. 

L. Smoking and vaping are not permitted inside the pool fencing.

M. Appropriate swimming attire is required. In the event of a dispute the Manager will make the final decision.

N. Members and guests may not leave belongings unattended on tables and chairs in the pool pavilion. In the event that items are left unattended and are prohibiting other members from using the pavilion, Management reserves the right to move such belongings.

O. No running on the pool deck.

P. Dunking, pushing others in, throwing others, shoulder rides (including chicken fights), and hitting others with pool noodles or toys are prohibited. Splashing with pool noodles (slamming noodles onto the water) is also prohibited.

Q. No hanging on the basketball net or rim.

R. No diving in the shallow end (3ft-5ft), diving is only allowed in the diving well when the diving boards are open.

S. Diving Board rules will be posted on the pumphouse door and in the office.


IV. Health and Safety

A. All members shall observe all common recognized rules of sanitation and safety.

B. All swimmers shall shower before entering the pool.

C. Admission to the pool may be refused to anyone with colds, cough, inflamed eyes, infections, and so forth. No one will be admitted to the pool wearing bandages.

D. No one over the age of six may enter the water in the baby pool area. A parent or a responsible person (15 years of age) must accompany a child in the baby pool area at all times. Children not bathroom trained are required to wear swim diapers. Swim diapers are available for purchase at the pool office.

E. Toddler friendly toys are permitted in the baby pool area.

F. No one shall use the deep and/or diving well of the pool unless he/she is capable of passing a basic swimming test - crawl stroke - two widths of the pool and treading water for two (2) minutes. Guards may request this test at their discretion. No free swimming will be allowed in the diving well when the boards are in use.

G. Children under the age of 10 must be accompanied by a responsible person who is at least 15 years of age. This person is to exercise continued supervision over his/her charge.

H. No pets are permitted on the Club premises.

I. Fifteen minutes prior to each hour, there will be a 15-minute rest period for all persons under 18 years of age. Persons 18 and over will be allowed in the pool during this time. Parents may take their babies, 3 years and under, into the pool, diving area included, during the rest period. It is emphasized, however, that parents must be within arm’s reach and are solely responsible for their child.

J. During rest period, the north part of the pool (area nearest the parking lot) shall be used by adults standing in the pool and adults with babies. The south side of the pool will be reserved for adults who wish to swim laps. During rest period, children unable to use the pool must remain 1 cement block back from the pool edge, this means no feet dangling in the pool.

K. No running, pushing, wrestling, or undue disturbance shall be permitted in or about the pool area.

L. Flotation devices shall be allowed in the pool at the Manager's discretion. No one may dive or jump from the pool edge onto equipment.

M. No glass, sharp objects, or the like, shall be permitted within the pool premises at any time, including during all parties unless approved by the Board.

N. Non-swimming activities shall be confined to designated areas away from the main pool.

O. Members and guests must respect the instructions of the lifeguards on duty. Issues with rule interpretation should be addressed with the Manager on duty or the Board.


V. Guests

A. In the event pool or Club facilities approach congestion or overcrowding, it may be necessary for the Management to limit the number of guests admitted at any time to ensure the health, safety, and welfare of the members. If this occurs, notice will be sent via the Remind app.

B. All operating rules that apply to members, shall also apply to guests, and the conduct of guests is the direct responsibility of the sponsoring member.

C. Every guest must be registered and accompanied by a member. 

D. Contact Membership with questions about accommodations for out-of-town visitors.

E. Adult non-swimming guests of members may be admitted by the Club Manager or his/her designated representative for free.

F. Upon written request, pending approval, a limit of two babysitter passes per family may be issued to a person 15 years of age or older. The babysitter may not use the pool unless accompanied by the child(ren) for whom he/she is babysitting.

G. Admission price for guests is $10 every day. Children two and under are free with a paying adult. Board Members reserve the right to limit the number of times (currently 5) any guest is admitted during the swim season.

VI. Tennis Court Regulations

A. Abusive or profane language is prohibited.

B. Players are requested to refrain from striking the net tapes with their rackets. This accelerates the deterioration of the nets.

C. All borrowed equipment shall be returned to the poolhouse.


VII. Enforcement

A. Any violation of these rules by members or their guests shall subject family membership to suspension. A violation of the guest rules, such as allowing non-members to use your membership, will cause a minimum suspension of fifteen (15) days to the member involved. This is in accord with the procedure set forth in Article III, Section 9(a) of the Code of Regulations.


VIII. Membership

A. Family Membership dues are $537.50 (tax included) . A family is defined as three or more individuals that make up the family unit (e.g. Husband and Wife, Single Parent and Child, Husband, Wife and their children) and live within the same household. At least one member must be 18+. There is an Initiation Fee of $350 for new members, defined as anyone that was not a member the previous summer. 

B. Single Adult Membership is $295.63 (tax included). A Single Adult is defined as one person 18+ years of age. No children or grandchildren are included as part of this membership option. Children or grandchildren may come as guests. The dues are paid on the same timing as the Family Membership. There is an Initiation Fee of $350 for new members, defined as anyone that was not a member the previous summer. 

C. Couples Membership is $360.13 (tax included). A Couple is defined as two people living in the same household, one member must be 18+. The dues are paid on the same timing as the Family Membership. There is an Initiation Fee of $350 for new members, defined as anyone that was not a member the previous summer. 

D. Sustaining Membership is $75. Available to members in good standing. This places your membership in hibernation for one season. There are no membership privileges during a sustaining season, but it keeps your membership dormant and available for the next season to avoid having to pay the Initiation Fee of $350.

E. Swim Team Memberships are available for non-member swimmers ages 13 and over, by June 1 of the current year. Swim Team members are allowed access to Four Seasons Towne Club for all swim practices, swim meets, and any swim team activities. Swim Team members are not allowed use of Four Seasons Towne Club during open swim or non-swim team activities. The Board reserves the right to make exceptions to these rules and membership options on a case by case basis.

F. Cancellation of any membership is subject to a $150 cancellation fee, up to May 15th, after that date no refunds will be given.

G. To become a board member you must be a member in good standing for three consecutive years.

H. Payment is due by March 31st every year. There is a $100 late fee until April 21st, then the late fee increases to $150. Memberships not purchased by May 7th will result in your membership being canceled. In order to rejoin you will need to join the waitlist and then you will be responsible for the $350 initiation fee.


EMPLOYMENT

Snack Bar: Members 14 years of age and older may apply for employment in the snack bar for the pool season. Persons interested in applying for employment must turn 14 years of age by the first day of employment and submit an application to the pool manager. Applications for employment are resubmitted annually. 

Lifeguards: Lifeguards must be age 15 and certified before they can work. They can apply with information regarding the classes they are taking and their intent, but they must have proof of age and certification before they can be scheduled to work. 

Head Lifeguards: Lifeguards who have worked as lifeguards for at least one summer at Four Seasons may apply for the Head Lifeguard position. 

Assistant Manager: Assistant Managers must be at least 18 years of age. Previous experience working at a pool is preferred.

Manager: Managers must be at least 18 years of age. Previous experience working at a pool is preferred.

Four Seasons Photography and Marketing

By registering as members of Four Seasons, all members understand and agree that Four Seasons may use photographs of members for appropriate purposes, including but not limited to: still photography, videotape, electronic and print publications, the pool website, and pool social media in order to promote, advertise, and/or celebrate the club.


Member Agreement, Waiver, Release, Indemnification of All Claims & Covenant Not to Sue


NOTICE: THIS IS A LEGALLY BINDING AGREEMENT. Read this section carefully and in its entirety. By signing this agreement, the undersigned members verify that they have read and will comply with the Four Seasons Swim Club (hereinafter “4S”) Pandemic Plan and that they give up any right to bring a court action to recover compensation or obtain any other remedy for any personal injury or property damage however caused arising out of participation in 4S programs and/or activities and/or accessing 4S facilities, now or at any time in the future.


Acknowledgment of Risk

The undersigned members hereby acknowledge and agree that participation in 4S swimming and other activities comes with inherent risks, including but in no way limited to: (1) slips, trips, and falls, (2) aquatic injuries, (3) athletic injuries, and (4) illness, including exposure to and infection with viruses or bacteria. The undersigned further acknowledge(s) that the preceding list is not inclusive of all possible risks associated with 4S participation and that said list in no way limits the operation of this Agreement.


Coronavirus / COVID-19 Warning & Disclaimer

Coronavirus, COVID-19 is an extremely contagious virus that spreads easily through person-to-person contact. Federal and state authorities recommend social distancing as a means to prevent the spread of the virus. COVID-19 can lead to severe illness, personal injury, permanent disability, and death. Participating in 4S programs or accessing 4S facilities could increase the risk of contracting COVID-19. 4S in no way warrants that COVID-19 infection will not occur through participation in 4S programs and/or activities and/or accessing 4S facilities.


Waiver, Release, & Covenant Not to Sue

In consideration of participation in 4S programs and/or activities and/or accessing 4S facilities, the undersigned AGREE TO RELEASE on behalf of themselves, their minor children, their wards, their heirs, representatives, executors, administrators, and assigns, and HEREBY DO RELEASE 4S and its officers, directors, employees, volunteers, agents, and representatives (“Releasees”) from any causes of action, claims, or demands of any nature whatsoever including, but in no way limited to, claims of negligence, which undersigned, themselves, their minor children, their wards, their heirs, representatives, executors, administrators and assigns may have, now or in the future, against 4S on account of personal injury, property damage, death or accident of any kind, arising out of or in any way related to the use of 4S facilities/equipment or participation in 4S programs/activities whether that participation is supervised or unsupervised, however the injury or damage occurs, including, but not limited to the negligence of Releasees.


Indemnification and hold harmless agreement

In consideration of participation in 4S programs and/or activities and/or accessing 4S facilities, the undersigned members HEREBY AGREE TO FULLY INDEMNIFY AND HOLD HARMLESS Releasees from any and all causes of action, claims, demands, losses, or costs of any nature whatsoever arising out of or in any way related to the use of 4S facilities/equipment or participation in 4S programs/activities. Such FULL INDEMNIFICATION would include, but is not limited to, reimbursement of legal fees and expenses incurred by Releasees to enforce this agreement.

The undersigned members further AGREE TO FULLY INDEMNIFY AND HOLD HARMLESS Releasees from any and all causes of action, claims, demands, losses, or costs of any nature whatsoever arising out of or in any way related to the use of 4S facilities/equipment or participation in 4S programs/activities brought by on or behalf of guests of members against releasees. Such FULL INDEMNIFICATION would include, but is not limited to, reimbursement of legal fees and expenses incurred by Releasees to defend against any claims made by undersigned member’s guest(s).

The undersigned hereby certify that they have full knowledge of the nature and extent of the risks inherent in 4S participation and that I/they voluntarily assume said risks. The undersigned understand(s) that I/they will be solely responsible for any loss or damage, including personal injury, property damage, or death, sustained during the use of 4S facilities/equipment or participation in 4S programs/activities. The undersigned, by signing this agreement, HEREBY WAIVE ANY CAUSE OF ACTION WHATSOEVER AND RELEASE Releasees from all liability for such loss, damage, or death.

The undersigned on behalf of themselves, their minor children, and/or their wards, further certify that I/they are in good health and have no conditions or impairments which would preclude safe participation in the use of 4S facilities/equipment or participation in 4S programs/activities.
